NSW:Government sly about deficit - Hockey

The federal opposition's accused Labor of being sly and arrogant for sneaking out a
warning about a possible larger than expected budget deficit .. on the same day as the
royal wedding.

Shadow treasurer JOE HOCKEY says it's taking out the garbage on Prince WILLIAM and
KATE MIDDLETON's big day .. and hoping that no one will notice.

Today's Australian Financial Review has an interview with Treasurer WAYNE SWAN in which
he says a slump in revenue could push the budget deficit out to 50 billion dollars ..

up from 41 billion forecast in its mid-year economic review.

QLD:Community gathers to remember fire victims

EDS: Removes literal in intro

By Petrina Berry

BRISBANE, Aug 25 AAP - Misi Matauina is praying for God to one day reunite him with
his partner and two daughters who perished in a house fire that killed 11 and left a community
in shock.

The 26-year-old father maintained a vigil outside the burnt shell of the Slacks Creek
house, south of Brisbane, on Thursday night as more than 3000 gathered at a local sports
hall to pay their respects and pray for the victims and their families.

The local Samoan and Tongan community packed the Logan Sports Centre and filled it
with their rich voices in a heartfelt rendition of Amazing Grace during the two-hour gathering.

Premier Anna Bligh, Logan City mayor Pam Parker, football star Karmichael Hunt, and
senior police and fire officers were also present.

In a letter read out by his oldest sister, Misi described his partner Annamaria Taufa,
23, as someone he was fortunate to have shared special times with.

"To my dear Maria, thank you for being a rock in our family - the one we'd always count
on to drop whatever you're doing just to fulfil our needs," his sister struggled to read
through her sobs.

"The one who'd go to the moon and back just to put a smile on our faces."

His letter described his longing to be with his family.

"You left me too soon and I hope and pray that one day the good Lord will bring us
back together."

Missing the ordinary but now invaluable moments together, he asked his dead wife: "Make
sure they've (the children) got their warm clothes on.

"Don't forget Kalahnie's medicine and I'm sure Lahania will need to do her homework.

"Send my love to my girls."

Jeremiah Lale, 36, who lost his wife and five children in the fire, was also absent
after vowing to remain at the scene of the tragedy until all the bodies were retrieved.

So far the remains of two of the victims are yet to be recovered.

The remains of Misi's youngest daughter, three-year-old Kalahnie Taufa, was the last
of five removed from the house on Thursday, while four others were removed the day before.

Annamaria's father, the family's patriarch, Tau Taufa, 65, who was lucky to have escaped
the fire, was the only survivor at the gathering.

Adding a touch of humour to the sad occasion, he told the gathering he always thought
Annamaria, who studied law, would grow up to be the prime minister.

He also spoke of his love for his wife, Fusi Taufa, 57, and of feelings of anger as
he comes to terms with the enormous loss.

"Tonight is a very confusing occasion," he said.

"Sometimes I get angry at God."

He described the deaths of his family members as a sweet victory for God.

"It's a sweet victory to Our Father who want more good people working in heaven,"he said.

"There's not enough good people, that's why he took my people."

Ms Bligh told the gathering the entire state shared the families' sorrow.

"We come together tonight because we know grief can only be borne if it is shared,"

the premier said.

A message with similar sentiments from Prime Minister Julia Gillard was read out.

Military calls for end to labor strikes in Egypt ; Last of protesters invited to disperse as generals consolidate their control

Military calls for end to labor strikes in Egypt ; Last of protesters invited to disperse as generals consolidate their control
Byline: ANTHONY SHADID
Type: News

In its clearest elaboration since taking power Friday of its plans for Egypt, the military said it would put consitutional changes to a referendum and rule until elections are held within the next six months.

The Egyptian military moved to clear the last protesters from Tahrir Square on Monday as the armed forces consolidated their control over what they have called a democratic transition from nearly three decades of authoritarian rule by President Hosni Mubarak.
A day after the military dissolved Parliament, suspended the Constitution and called for elections in six months in sweeping steps that echoed the demands of protesters, red-bereted military police officers urged the final few protesters in the square to leave. The huge plaza in central Cairo had become the epicenter of 18 days of protest that ended Mr. Mubarak's rule on Friday, with hundreds of thousands of people gathering to call for his departure.

But even as the police moved to vacate the square, leaving only a handful of bystanders and people cleaning the streets after the weeks of protest, the governing military council issued a communique urging labor leaders to end the strikes that have broken out in the aftermath of the revolution.

The statement, read on state TV, seemed aimed not just at strikes against private industry but also at a fresh wave of smaller demonstrations by state employees, including ambulance drivers, police officers and transport workers, demanding better pay and working conditions. Several hundred police officers demonstrated in the square -- not, as at the beginning of the revolt, to suppress protest, but to seek better working conditions and public sympathy.

The military leaders now governing Egypt have told a coalition of young revolutionaries that they plan to convene a panel of distinguished jurists to submit a package of constitutional amendments within 10 days for approval in a national referendum within two months, setting a breakneck schedule for the transition to civilian rule.

Just as dramatic a sign of how radically Egypt is changing was the way the army and the protesters disclosed their plans. Two top generals sat down Sunday night to talk about their country's future with seven of the revolution's young organizers -- including the Google marketing executive Wael Ghonim -- and the young organizers posted their notes on the meeting directly to the Internet for the Egyptian public to see.

How completely the military will deliver on its promises of a transition to a constitutional democracy will not be clear until the election. But the young revolutionaries -- most in their early 30s - - were clearly impressed by the deference they received from the military officials, Maj. Gen. Mahmoud Hijazi and Maj. Gen. Abdel Fattah.

"We all sensed a sincere desire to preserve the gains of the revolution and unprecedented respect for the right of young people to express their views," two of the young organizers, Mr. Ghonim and Amr Salama, wrote in their Facebook posting, with the disclaimer that they were speaking only for themselves.

Since seizing power on Friday, the military has struck a reassuring note, responding in words and actions to the platform articulated by hundreds of thousands in Tahrir Square. But beyond more protests, there is almost no check on the sweep of military rule. While opposition leaders in Egypt welcomed the military's moves, some have quietly raised worries about the future role of an institution that has been a pillar of the status quo, playing a crucial behind-the-scenes role in preserving its vast business interests and political capital.

"Over the next six months, I am afraid the army will brainwash the people to think that the military is the best option," said Dina Aboul Seoud, a 35-year-old protester, still in the square on Sunday. "Now, I am afraid of what is going to happen next."

The prime minister of the Palestinian Authority, Salam Fayyad, dissolved his cabinet on Monday and was immediately reappointed by the president to form a new one, Isabel Kershner reported from Jerusalem. The move was the latest in a series of political steps taken by the authority after the popular uprisings in Tunisia and Egypt.

Ghassan Khatib, the spokesman for the West Bank-based Palestinian government, said that there had been plans for a cabinet reshuffle for months, regardless of the recent turmoil in the region, but that the process had "taken longer than expected."

FED:Senate results unknown for weeks

EDS: Reissuing, correcting election timeline in abstract and intro

CANBERRA, Aug 31 AAP - It could be weeks before the official winners of Senate seats
following the August 21 federal election are known, the Australian Electoral Commission
(AEC) says.

AEC spokesman Phil Diak said on Tuesday that the declaration of the Senate was typically
the last thing to be finalised post-poll, because allocating preferences was very complex.

"We can't run the process to transfer surpluses and distribute preferences for any
senatorial contest until all votes are counted, and all below-the-line data entered and
all the above-the-line ticket votes are on the system," he told AAP.

"It is still ongoing in every state and territory."

Declaration votes, including absentee and postal ballot papers, continue to be counted
by the AEC.

It has taken about one month for the writs, naming elected upper and lower house candidates,
to be returned in the past.

Although no official Senate results are known, Australian Greens leader Bob Brown has
already claimed his party retained two upper house seats, and gained four more at August's
poll.

Mr Diak said such predictions were not related to AEC counting.

"In situations where people have claimed (victory) and others have conceded, all of
that is separate to the AEC formally declaring positions," he said.

Qld: Nine to stand trial over death of Thurston's uncle

By Christine Flatley

BRISBANE, Dec 10 AAP - Five men and four teenage boys have been committed to stand
trial for the murder of rugby league star Johnathan Thurston's uncle.

After eight days of evidence in the Brisbane Magistrates Court, Magistrate Noel Nunan
found on Thursday there was potentially enough evidence to convict the nine of killing
Richard Saunders in a park at Woodridge, in Brisbane's south, on October 25 last year.

The accused, aged between 15 and 25, chose not to enter a plea as they were committed
to stand trial for murder in the Supreme Court in Brisbane.

They also face charges of grievous bodily harm and assault occasioning bodily harm
while armed and in company.

During the committal hearing the court was told the accused bashed Mr Saunders and
two of his friends, Harold Bond and Gordon Willis, after a dispute over a stolen purse.

The court was told that crucial closed-circuit TV footage that could shed light on
how the incident unfolded was missing, because the camera was probably facing the wrong
way at the time.

The footage retrieved by police only shows Mr Bond lying on the concrete path, and
does not show an attack on the three men.

Eight of the accused were remanded in custody until their trial, while the ninth remains
on Supreme Court bail.

A date for the trial is yet to be fixed.

Federal Treasurer WAYNE SWAN isn't saying if he's seen the report .. but he's told
the Nine Network he can't pre-empt its findings.

Mr SWAN was the target of opposition accusations he favoured a car dealer mate of Prime

Mr SWAN says he acted appropriately .. and the whole smear campaign was based on a

A central Queensland man has been arrested after allegedly tapping into wireless internet
connections to send threatening emails.

A 22-year-old man from Frenchville was arrested by police at North Rockhampton Park
yesterday in an undercover operation.

Police allege he'd been sending a number of threatening emails to various individuals
and organisations since August this year.

He apparently sent the emails from wireless internet connections he was able to access
around Rockhampton .. preventing police from tracing the exact source of the emails.

Police intercepted an email he sent on December 3 which demanded a large sum of money
be delivered to North Rockhampton Park .. and met him at the location and arrested him
without incident.

FED: Aust needs Labor to deal with future challenges - Rudd

"My name's KEVIN .. I'm from Queensland .. and I'm here to help".

With that line .. a specially-commissioned song .. and the slogan .. "Australian Labor
.. Fresh Thinking" .. KEVIN RUDD has taken the stage for his first Labor national conference
as opposition leader.

Mr RUDD has told the conference the nation needs to elect Labor at the next federal
election to deal with the challenges of the future .. rather than sticking with a government
anchored in the past.

In a speech on enduring Labor values .. he's told the conference Australia's approaching
a crossroads and Australians need to deal with it head on.

He says one thing we know for certain is the history of nations is made up of those
who understand .. anticipate and act on the challenges of the future .. and those who
do not .. those who instead bury their heads in the sand and hope it will all just go
away.

Mr RUDD says Labor is at its best as a navigator of Australia's future .. drawing on
the achievements of past leaders like BEN CHIFLEY and JOHN CURTIN.

He told the conference the election in just a few months time will be about the future
versus the past .. and while the ALP is the party of the future .. the Howard government
has become the party of the past.

from a lack of supplies so bad .. that soldiers had to drink water from the canteens of
dead Hizbollah foes.

A 22-year-old infantry man says he believes they fought for nothing .. clearing houses
that will be reoccupied by Lebanese Hizbollah guerrillas in no time.

Poll Qld (BRISBANE)

The latest opinion poll indicates Queensland Premier PETER BEATTIE is set to keep his
job after the next state election.

49 per cent and the coalition 51 per cent.

Ajax (MELBOURNE)

The Australian Workers' Union's Victorian secretary .. CESAR MELHEM .. says talks have
progressed .. with both sides now agreeing to swap documents.

Qld: Doubt hangs over Ron Boswell's political future

By Jade Bilowol

BRISBANE, Dec 14 AAP - Veteran Queensland Nationals senator Ron Boswell has refused
to say if he will contest the next federal election.

Senator Boswell would not be drawn on whether he would pursue his spot in the Nationals'
Senate team, as nominations opened today for the next election, due in 2007.

"He will not be making any comment at this stage," a spokeswoman for the senator said.

Queensland Nationals leader Lawrence Springborg said he was unsure if 65-year-old Senator
Boswell, who was elected to the senate in 1983, would run.

"I've got no doubt that if he does he'll be a part of the team ... it's up to the delegates
to decide where he goes (on the ticket)," he said.

Asked if he would encourage Senator Boswell to continue on after his current six year
term expires in June 2008, Mr Springborg said it was up to Senator Boswell.

"I mean, he's done a fairly good job for Queensland in the past.

"But can I just make the point that there's also a range of other very good people
who are interested in this," he said.

"And I think that we have got to treat people on how they perform on the day and how
they have performed in the past."

Animosity has recently marred the Queensland Nationals Senate team, with Senator Boswell
deriding newcomer Barnaby Joyce's tactics as "populist".

After Senator Joyce voted against the government's voluntary student unionism (VSU)
laws on Friday, Senator Boswell said crossing the floor threatened unity of the coalition
government.

Nationals Queensland Director Brad Henderson said nominations would close in February,
with Senate ticket selection to be held before the Nationals' annual conference in July.

Low-tech blues.(merits and drawbacks of technological advances)(Column)

WE LIVE IN AN ERA of unparalleled technological achievement. Information abounds, communication channels swell, the massive planet shrinks. And I had lots of quiet time today to think such lofty thoughts, since I was stuck in traffic for an hour and the cellphone kept cutting me off.

Intellectually, I know we're living life in the fast lane. But viscerally, it feels a lot like we're spinning our wheels. I've got a great new computer system that freezes about once a week and occasionally refuses to let me use the Zip drive. My cellphone is pretty sleek, but it often sounds like I'm dialing up another country when I call home, and it routinely drops my calls to colleagues in other states. There's a flock of satellites floating above us--snapping spy pictures and locating jetliners--yet they're of no help whatsoever when I'm trying to find my kids, my golf ball, or my car at the baseball stadium.

But perhaps nothing symbolizes the disconnect between high technology and low problems better than this: I don't know what time it is. As I sit here, my telephone display says it's 4:02 p.m., my watch says it's 4:05, and my desk clock says it's 4:07. Worse, my most sophisticated piece of office hardware, the PC, declares it to be 3:37--a full half-hour behind the desk it sits upon--and it's busily stamping all of my e-mail and documents accordingly. I don't even want to know what time my VCR thinks it is.

A big problem? Maybe not. But talk about an indictment of the information age. And it all points to a conclusion we feel in our gut but don't often say aloud: Technology isn't doing nearly as much to make our lives simpler or better or faster or safer as conventional wisdom says it is. It's the dysfunctional underbelly of the body digital.

These daily disappointments seem to stem from one of two sources: Either our high-tech products don't really work as well as advertised, or they just aren't aimed at solving everyday problems. Buggy computers, scratchy cellphones, and the like fall into the former category, and they're plenty annoying. But the gap between existing technologies and existing problems is cause for even greater frustration, since solutions appear to be so close at hand.

Take the time problem. It's not that we, as a species, are unable to keep track of time. We even have a government agency on the job. The National Institute of Standards and Technology (NIST) in Boulder, Colorado, has an atomic clock that minds the time down to the vibration of a cesium atom (9,192,631,770 oscillations per second, if you're keeping score at home). And you can even go see exactly what time it is on the NIST Web site at nist.time.gov. So why--with my PC connected to the Internet, my phone connected to everybody, and satellites hovering me--don't any of my clocks know the correct time?

The answer, of course, is that no one has taken the time to devise a system whereby all of these devices are automatically fed the exact time and kept current around the clock, as it were. Well, almost no one. Chaney Instrument Co. of Lake Geneva, Wisconsin, sells reasonably priced clocks and watches under the Atomix brand name (www.atomixtime.com) that are updated several times a day to within a fraction of a second by receiving radio signals from NIST. (This includes adjustments for day-light-saving time.) Which only serves to underline the premise and raise the question: Wily isn't every timepiece and electronic gadget on the planet so connected?

There are many more important frustrations too. GPS technology's usefulness today may be largely limited to road navigation in rental cars, but why aren't we routinely using this same satellite-location system to find our cars, whether parked or stolen? (An aftermarket system called LoJack provides localized signaling in some areas, but isn't this pervasive enough to warrant a standardized system that all police departments use?) More urgently, why can't we bury GPS transmitters inside kids' jewelry or shoes to help reduce the number of missing children? You could even do the same for lost pets if transmitters were in every collar.

If satellite technology is underused, terrestrial wireless is undercooked. Wireless phone coverage is good, in theory, but clarity and reliability are still sore subjects with every cellphone user I know, a full two decades after the advent of cellular. And for all of the talk about the wireless Web, it remains an elusive place. My so-called Web phone barely worked at all, and the wireless modem inside my handheld computer is problematic enough that I leave it off most of the time, and check my e-mail on my wired PCs. Hey, I tried.

In fact, with so many types of wireless technologies allegedly being perfected, you'd think companies would be lining up at my door selling me on the benefits of new communication, entertainment, and security systems for my home. No one's knocked yet. Except the cable company--and it wants to bury new wires in my yard so it can charge me for pay-per-view movies.

If the laughable lament of the early 20th century was that everything good had already been invented, then the curmudgeonly complaint of the early 21st may be that we have more technology than common sense to apply it.

Financial Meltdown? Don't Worry, LogInto.Org Launches Today.

Charlotte, NC (PRWEB) August 10, 2011

With the slew of new websites being released every day, and each with their own form of login mechanism, it is no wonder an all-in-one website has surfaced to remedy the problem of finding the login for each of these popular sites like Facebook, Gmail, and many others. LogInto.Org launched this week to provide website users a way to keep up with these usually difficult tasks of finding a login, ensuring it is a real login page, and even giving people the ability to categorize the login pages they need. When asked about the new concept, Matthew Dixon, CPM of Paul Internet responded with "Don't worry about the financial meltdown, LogInto.org launches today." A perfect analysis reflecting the creativeness found behind the project from Internet pioneer Michael Paul.

Phishing attacks and fake login pages have also numbered in abundance online because so many people simply search for a login page in a search engine like Google instead of visiting a website directly. This method has provided the opportunity for hackers and such to place a rather convincing website look-a-like in the search results that has even outranked the original site a user was looking for. Then on another note, many websites have nearly hidden the login page due to on-page congestion, making it increasingly difficult to find the right login page. LogInto.Org provides a solution to both of these major problems for login pages.

LogInto.Org was founded on the basis of needing a one stop shop to make sense of the increasing complexity of the web. LogInto.Org has a great amount of features to manage login pages with a simple, and free, user registration process. After a quick signup people are able to start categorizing favorite login sites without having to come back to them at a later time and start the search process over. The site even keeps the most up to date logins active for the user archives, which was one less thing to worry about as websites shift pages between regular login intervals.

Even without the free registration process, LogInto.Org provides great user value with a front page custom search box. For example, use the search box for The Wall Street Journal Online and get directed straight to the login page to quickly catch the latest Dow Jones roller coaster. A few seconds using a Facebook login, and users are on the way to watch their portfolio. Out of the numerous websites personally used each day, this nifty URL can go straight to the favorites list in order to manage those that are used continuously. LogInto.Org has definitely proven itself to be a breath of fresh air. Yes, good times are just ahead.

FDA TAKES ACTION AGAINST ILLEGAL MARKETING OF TOBACCO PRODUCTS.

Silver Spring, MD -- The following information was released by the U.S. Food and Drug Administration:

The U.S. Food and Drug Administration today announced it issued 11 warning letters last week to online retailers for illegally marketing tobacco products with misleading or unsubstantiated claims or descriptors indicating that they can be used to reduce harm or the risk of tobacco-related disease.

"There is no known safe tobacco product. It is illegal for tobacco companies or retailers, including internet sellers, to make unsubstantiated claims or statements that imply tobacco products reduce health risks," said Lawrence R. Deyton, M.S.P.H., M.D., director of the FDA's Center for Tobacco Products. "FDA will pursue enforcement actions to protect the public health."

The FDA cited the online retailers for a variety of illegal marketing claims that violate the Federal Food, Drug and Cosmetic Act, including use of terms such as: "Light"; "Low"; "Mild"; "Less toxic"; or "Safer."

These claims are not permitted unless a company has received an order from the FDA allowing it to market a product with these claims based on scientific evidence. The agency has issued no such orders to date.

In the past, some tobacco products were marketed with descriptors that indicated they were safer or had a modified risk. Those products were never proven to reduce health risk. Those deceptive marketing practices may actually have led to continued or increased tobacco use and harm to consumers who incorrectly thought they were using a product that might be less risky. This kind of marketing is now illegal under the Federal Food, Drug, and Cosmetic Act.

In addition to these marketing violations, other cited violations included the illegal sale of flavored cigarettes.

The FDA's Center for Tobacco Products conducts routine monitoring and surveillance of tobacco product marketing, advertising and promotion to assess compliance with the law. The agency will consider additional sanctions for failure to correct the violations cited in warning letters, which may include civil money penalties, no-tobacco-sale orders, seizure, injunction and/or criminal prosecution.

Clear Channel Radio and Relativity Media Partner to Create Unique Integrated Programs for Films.

Clear Channel Communications, the leading media company in America with more reach in the U.S. than any radio or television outlet, and Relativity Media, a next-generation studio that focuses on creating, financing and distributing entertainment content and intellectual property across multiple platforms, announced they have entered into an unprecedented multi-media agreement to promote a number of major film releases over the next 12 months.

KIIS-FM radio show "On-Air with Ryan Seacrest" host Ryan Seacrest, in partnership with Clear Channel Radio, helped orchestrate this innovative relationship with Relativity Media, which is designed to drive box office sales and promote upcoming entertainment properties by tapping into Clear Channel's monthly reach of 237 million in a creative and compelling manner.

The companies officially kicked off their collaboration with the promotion of the film Limitless, starring Bradley Cooper, Abbie Cornish and Robert De Niro, which finished #1 at the box office during its opening weekend with a 25% lead over that weekend's #2 film and 43% over the other weekend openers. "For Limitless, we feel the Clear Channel promotion significantly impacted our awareness and helped drive our successful opening weekend," said Ryan Kavanaugh, CEO of Relativity Media.

Clear Channel offers an unparalleled variety of cross-platform media assets. For Limitless, the companies leveraged the film's Limitless theme and the star power of Bradley Cooper to serve as a catalyst for interest in the movie. These included custom interviews with exclusive insight into the film; "limitless" music hours that indicated 'you're listening to the Z100 limitless music hour sponsored by Limitless'; social media integration on station Facebook pages offering listeners the chance to win Limitless music; rich media overlays featuring Bradley Cooper walking onto home pages to promote the film; countdown clocks both on-air and on-line to provide high frequency reminders to the listeners and more.

The campaign was executed across a broad combination of Clear Channel's assets, including national radio programs like "On-Air with Ryan Seacrest" and dozens of top-rated local radio station programs like Boy Toy Jesse's show on KIIS-FM in Los Angeles and Elvis Duran's show on Z100 (WHTZ) in New York. Also included were digital and mobile ad units, digital outdoor billboards in strategic locations around the country like Times Square, and national and local commercial inventory.

Relativity Media provides filmmakers and talent to create exclusive content that will be shared with Clear Channel's listeners and viewers, both digitally and on-air.

With a national footprint across 150 cities and appealing performance against the coveted 18-34 movie-going audience, Ryan Seacrest also serves as a significant cornerstone to the deal, offering unique multi-media platforms - including "On-Air with Ryan Seacrest," "AT40" and ryanseacrest.com -- which will distribute compelling content featuring A-list Hollywood actors and actresses.

Kavanaugh added, "As the consumer looks more and more to digital and interactive content, Clear Channel's cross-platform deal is a critical step in providing Relativity a direct link to its movie-going audience. Ryan Seacrest really envisioned this integrated partnership, and brought together all of the Clear Channel assets, people, and venues. Without his leadership, this deal would have never happened."

"Both Kavanaugh and Seacrest understood immediately the impact of leveraging Clear Channel Radio's portfolio of media assets and their vision was instrumental in developing this partnership," said Bob Pittman, Chairman of Media and Entertainment Platforms for Clear Channel Radio. "We look forward to developing even more creative campaigns going forward that will drive attendance for Relativity releases."

"Relativity Media is an ideal partner because of its interesting and compelling content offerings. Winklevoss twins must accept Facebook deal - court.

Mark Zuckerberg won a legal battle against former Harvard classmates who accuse him of stealing their idea for Facebook, but the feud made famous on the silver screen is not over yet. Cameron and Tyler Winklevoss must accept a cash and stock settlement with Facebook that had been valued at $65 million, a U.S. appeals court ruled on Monday. Meanwhile, a New York man filed an amended lawsuit against Zuckerberg on Monday, citing a 2003 email in which Zuckerberg discusses an urgent need to launch his site before "a couple of upperclassmen" could launch theirs, an apparent reference to the Winklevoss twins. The Winklevoss brothers argued their settlement with Facebook was unfair because the company hid information from them during talks. But the twins were sophisticated negotiators aided by a team of lawyers, 9th U.S. Circuit Court of Appeals Chief Judge Alex Kozinski wrote for a unanimous three-judge panel. "At some point, litigation must come to an end," Kozinski wrote. "That point has now been reached." An attorney for the brothers, Jerome Falk Jr., said on Monday his clients would seek a rehearing before a larger, "en banc" group of 9th Circuit judges. That larger group can overrule a three-judge panel, although only a fraction of cases undergo such a review. Should the 9th Circuit refuse to rehear the case, the last option would be an appeal to the U.S. Supreme Court. Falk said he "respectfully" disagreed with the 9th Circuit's conclusions. The 6-foot, 5-inch (1.96-meter) Winklevoss brothers are Olympic rowers who participated in the 2008 games in Beijing, and their saga with Zuckerberg was dramatized in the film "The Social Network." In the movie, actor Armie Hammer played both identical twins. Zuckerberg's character snidely called them on-screen the "Winklevi." FACT AND FICTION The twins, along with Divya Narendra, started a company called ConnectU while at Harvard. They say Zuckerberg stole their idea. Facebook denies these claims. Facebook took in $1.2 billion of revenue in 2010's first nine months, according to documents that Goldman Sachs provided to clients to entice investors in a special fund set up to invest in the giant social networking firm. The company was valued at $50 billion as part of that transaction. The company said on Monday it is evaluating the Internet market in China, but a source indicated it has not yet signed a business deal with any companies there. The Winklevoss twins and Narendra agreed to a settlement that had been valued at $65 million. But they argue that, based on an internal valuation that Facebook did not reveal, they should have received more Facebook shares as part of the deal. A lower court had granted Facebook's request to enforce the settlement with the Winklevoss twins and Narendra. The 9th Circuit agreed on Monday. "The Winklevosses are not the first parties bested by a competitor who then seek to gain through litigation what they were unable to achieve in the marketplace," Kozinski wrote. Facebook deputy general counsel Colin Stretch said the company appreciated the court's careful consideration of the case and was "pleased" it ruled in their favor. The case is not the only ownership dispute Zuckerberg must fend off. A New York businessman, Paul Ceglia, claims a contract with Zuckerberg to develop and design a website entitled him to an 84 percent stake in the privately held social networking site. In a new twist to the long-running case, Ceglia filed an amended lawsuit on Monday, in which he outlined an 2003 email from Zuckerberg that suggested the Facebook founder stalled "a couple of upperclassmen here" from launching their competing website. The lawsuit does not specifically name the Winklevoss twins. "If we don't make a move soon, I think we will lose the advantage we would have if we release before them," the lawsuit claims Zuckerberg wrote in an email. Ceglia claims Zuckerberg pleaded with him for money to finance the social network's set-up with the intention of getting it live before the other site. Facebook has repeatedly said it believes the lawsuit is fraudulent. Orin Snyder, a lawyer for the company, said Facebook looks forward to defending the case in court and on Monday characterized Ceglia's claims as "ridiculous."

About Stereotaxis

Stereotaxis designs, manufactures and markets an advanced cardiology instrument control system for use in a hospital's interventional surgical suite to enhance the treatment of arrhythmias and coronary artery disease. The Stereotaxis system is designed to enable physicians to complete more complex interventional procedures by providing image guided delivery of catheters and guidewires through the blood vessels and chambers of the heart to treatment sites. This is achieved using computer-controlled, externally applied magnetic fields that govern the motion of the working tip of the catheter or guidewire, resulting in improved navigation, shorter procedure time and reduced x-ray exposure. The unparalleled clinical capability of Stereotaxis has driven more than 130 hospitals to adopt magnetic navigation for a growing number of complex ablation cases in all four chambers of the heart. Stereotaxis technology is now installed and used by 9 out of the Top 10 Best U.S. Heart Hospitals as ranked by U.S. News and World Report, and more than one third of the EP academic training centers in the United States have included Stereotaxis into their arrhythmia treatment laboratories. The core components of the Stereotaxis system have received regulatory clearance in the U.S., Europe, Canada and elsewhere.

Fortner Software Makes Data Accessible; The HDF Browser 1.1 Promotes Technical Data Standards

STERLING, Va., Dec. 10 /PRNewswire/ -- Fortner Software announced today the release of its enhanced HDF Browser, a free technical data browsing tool which allows researchers and technical data workers to easily view data in the Hierarchical Data Format (HDF). HDF is a popular and widely accepted technical data standard designed to allow easy access and exchange of large and complex data sets. Available free on Fortner's Web site, http://www.fortner.com, the HDF Browser runs on Windows 95/NT and Power Macintosh systems.

Recognizing the need to store technical data in a consistent manner that can be shared across a variety of computer platforms, many scientific communities and organizations such as NASA, the Jet Propulsion Lab, DOE's Accelerated Strategic Computing Initiative, and Lamont-Doherty Earth Observatory have adopted the HDF standard. For example, HDF has been selected as the standard to distribute data from the Sea-Viewing Wide-Field-of-View Sensor (SeaWiFS), and the recently launched Tropical Rainfall Measuring Mission (TRMM) satellites. TRMM and SeaWiFS are essential parts of Mission to Planet Earth, NASA's long-range research effort to study the Earth as a global environmental system.

"With terabytes of research data being shared around the world on the Internet, the need for technical data standards has never been greater. HDF is the most popular choice because it is cross platform, self-describing, and supports multiple data types and objects," states Ted Meyer, Chief Technology Officer of Fortner Software. "Scientists don't want to spend weeks writing software to read data. The HDF Browser removes barriers to accessing data in the powerful HDF format."

The free HDF Browser opens HDF, ASCII or binary formatted data. It provides support for viewing all HDF data objects: data tables, multidimensional arrays, images, text, palettes, and attributes. Most HDF files contain many objects and the HDF Browser lets users view the hierarchical "directory" structure of the objects in a graphical window that displays the type of data contained in each object. This allows quick examination and exploration of any HDF file, without programming.

"The HDF Browser is a great way to easily access and explore our data without having to write programs in more complex languages," states Peter Ashcroft, of Remote Sensing Systems. "We can now peruse large amounts of satellite data at a glance." Remote Sensing Systems of Santa Rosa, CA, specializes in processing and analyzing microwave data collected by satellite microwave sensors.

New features in the HDF Browser 1.1 include the ability to open and view data in any plane of multidimensional data sets, support for viewing HDF Vdata tables, access to HDF Vgroups, and improved memory management for accessing the directory of very large HDF files. A new on-line manual describes all of the software's functionality. To assist users of the netCDF data format in viewing their data with the HDF Browser, Fortner Software has available for download a new utility that converts netCDF files to HDF.

The HDF Browser is a technology demonstration of Noesys, Fortner Software's commercial technical data mining application. Noesys provides extensive editing, analysis and visualization of technical data and provides point-and-click access and organization of data based on the HDF model. Noesys is available for $795 directly from Fortner Software and their worldwide network of resellers.

About the Hierarchical Data Format

Developed and supported by the National Center for Supercomputing Applications (NCSA) at the University of Illinois, HDF is a library and platform-independent data format for the storage and exchange of scientific data. It was originally developed to support the exchange of data between supercomputers and high-end workstations, but is now used on all computing platforms. The HDF libraries are in the public domain and can be downloaded at http://www.HDFinfo.com. The HDFinfo Web site is a clearinghouse of information about HDF.
